Welcome to Kinta! These Terms of Use govern your use of the Kinta mobile application ("Application") and the website at www.kinta.co ("Site"), owned and operated by Kinta Labs d.o.o., Savska cesta 32, Zagreb, Croatia.
By accessing or using Kinta, you accept the following terms. Please read them carefully.
Acceptance of terms
These Terms of Use, together with the Privacy Policy, form a binding agreement ("Agreement") between you ("User") and Kinta Labs d.o.o. ("Owner"), applicable to all users of the Application and the Site. By using either platform, you confirm that you accept all provisions of these Terms of Use. If you do not agree, please stop using the Application and the Site immediately. We reserve the right to update these Terms of Use and the Privacy Policy at any time. Any changes take effect upon publication on the Site and within the Application. Continued use of the Site or Application after changes are published constitutes acceptance of the revised terms. Definitions
The following terms are used throughout this document. "Agreement" means these Terms of Use and the Privacy Policy together, as a legally binding agreement between the Owner and the User. "Terms of Use" means this document, which governs the rules, rights and obligations of the User when using the Application and the Site. "Privacy Policy" means the document available on the Site and within the Application that explains how we collect, share and use your personal data, and your rights as a data subject. "User" means any person who accesses and uses the Application or the Site. "User account" means the unique account a User creates within the Application. "Application" means the Kinta software application, owned by Kinta Labs d.o.o., available on the Google Play and App Store platforms. "Site" means the website at www.kinta.co, owned by Kinta Labs d.o.o.. "Newsletter" means electronic notices sent to Users containing information, news and updates about the Application. "Owner" means Kinta Labs d.o.o., the owner of the Application and the Site. "Personal data" means any data relating to you as an identified or identifiable natural person. "Data processing" means any operation performed on personal data, including collection, recording, storage, use or deletion. "Pseudonymization" means processing personal data in a way that it can no longer be attributed to a specific person without the use of additional information kept separately. "Third parties" means organizations that the Owner works with.
Description of the service
The Kinta Application gives users a digital tool for tracking and managing personal finances. Through the Application, Users can set and track a budget on a daily, weekly or monthly basis, with real-time spending status. Users can scan receipts by capturing QR codes from fiscal or other receipts, which are automatically added to the Application. The Application allows unlimited archiving of scanned receipts and other entries. Users can log additional amounts, such as tips, alongside fiscal receipts, for more precise expense tracking. With Penny AI, our artificial-intelligence assistant, Users can get interactive analysis on request and real-time answers to financial questions. Users can also set reminders on receipts with a warranty period so they're notified before it expires. The Kinta Application aims to help Users organize their expenses and gain a clearer view of their personal finances. The Application does not provide financial advisory services.
Use of the application and newsletter
The Application is available for download via the Google Play and App Store platforms. Each account is automatically assigned a randomly generated 6-character ID code, used for internal identification within the Application. This pseudonymization measure significantly increases the level of privacy protection and data security for our Users. Users can subscribe to the Newsletter via the Site. When subscribing, we collect basic information, including name and email address, solely for the purpose of sending informational content, news and updates about the Application. By submitting this data, the User confirms consent to receive such communications electronically. Users can unsubscribe from the Newsletter at any time, after which no further communications will be sent to them, and their data will be deleted or archived in accordance with the Privacy Policy.
Payments
The Application offers the option to purchase Premium features, including but not limited to Penny AI, bank account linking, AI-powered widgets, and family sharing. Prices are clearly displayed within the Application before purchase. All payments are processed exclusively through the App Store and Google Play platforms. For subscriptions, renewal is automatic through the User's App Store or Google Play account unless cancelled at least 24 hours before the end of the current billing period.
Intellectual property
Kinta Labs d.o.o. owns the copyright to all content independently created and published on the Application and the Site, including but not limited to text, the Application's name, logo, design, graphic elements, software code and the functionality of the Application and Site. All such content is protected by copyright and other intellectual property rights under applicable law. Users are granted a limited, non-exclusive and non-transferable right to use the Application, solely for the purpose and in the manner set out in these Terms of Use. Any unauthorized copying, reproduction, distribution, modification or other use of the Application and its content that has not been expressly approved by Kinta Labs d.o.o. is prohibited. Any unauthorized use constitutes an infringement of intellectual property rights and may result in civil, administrative or criminal liability.
Limitation of liability
The Application does not provide financial advisory services. The User accepts that the Application provides services solely for informational and organizational purposes, for tracking and managing personal finances. While we strive to ensure the accuracy and currency of the data displayed, Kinta Labs d.o.o. does not guarantee the complete correctness, accuracy, reliability or completeness of data entered by the User, data automatically retrieved from fiscal or other receipts, or the responses and data generated by Penny AI. The User uses the Application at their own risk. The Owner is not liable for any direct or indirect damage that may arise from use of the Application, including but not limited to budgeting errors or issues related to warranties or transactions. The User is solely responsible for the accuracy and completeness of the data entered into the Application, as well as for their own financial decisions made based on information obtained through the Application.
Changes to the application and site
Kinta Labs d.o.o. reserves the right, at any time and without prior notice, to change, update, supplement or remove parts of the content of the Application and the Site, including functionality, text and visual information. The Application and Site may be temporarily unavailable due to technical maintenance, system upgrades, or other reasons. The User accepts that the Owner is not liable for any consequences that may arise from content changes or temporary unavailability, and that it is the User's responsibility to regularly check for updates and changes.
Circumstances beyond our control
Kinta Labs d.o.o. is not liable to the User for any breach of these Terms of Use caused by events or circumstances beyond its reasonable control.
Severability
If a competent court finds any provision of these Terms of Use invalid, the remaining provisions remain in full force. Kinta Labs d.o.o. and the User agree that, where applicable, an invalid provision will be replaced with a valid provision that most closely reflects the original intent of the parties.
Governing law and dispute resolution
Any disputes arising from these Terms of Use will be resolved before the competent court at the Owner's registered seat.
